1. Acceptance of Terms
By accessing or using the Nexus platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service.
These terms apply to all users of the platform.
2. Description of Service
Nexus is an AI-assisted automation platform for ecommerce businesses. It provides modules for customer support automation, abandoned cart recovery workflows, and performance analytics — primarily for stores running on Shopify.
Features, interfaces, and capabilities may change as the platform evolves.
3. No Performance Guarantees
Nexus does not guarantee specific revenue outcomes, conversion rate improvements, or support load reductions. Results vary significantly based on store setup, traffic volume, product type, and integration configuration.
AI-generated responses are provided on an "as-is" basis. You are responsible for reviewing AI outputs, particularly for edge cases, escalations, or sensitive customer interactions. We recommend maintaining a human oversight layer for all automated customer-facing communications.
4. User Responsibilities
You are responsible for ensuring that your use of the Service complies with applicable laws, including consumer protection, data protection, and electronic communications regulations in your jurisdiction.
You must not use the Service to send misleading, deceptive, or unsolicited messages to your customers. You retain full responsibility for the content and accuracy of automated messages sent through the platform.
You must keep your account credentials secure. You are responsible for all activity that occurs under your account.
5. Data and Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to data practices described in the Privacy Policy.
You represent that you have all necessary rights and consents to provide customer data to the Service, including consent from your customers where required by applicable data protection law.
6. Intellectual Property
The Nexus platform, including its codebase, design, and proprietary models, is owned by Nexus and its licensors. These Terms do not grant you any ownership rights in the platform.
You retain full ownership of your store data, customer data, and any content you provide. By using the Service, you grant Nexus a limited licence to process that data solely for the purpose of providing the Service.
7. Limitation of Liability
To the maximum extent permitted by law, Nexus shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to lost revenue, lost data, or business interruption.
Our total liability for any claim arising from these Terms shall not exceed the amount you paid for the Service in the three months preceding the claim.
8. Termination
You may terminate your account at any time by contacting us at support@aicommerce.app. We may suspend or terminate accounts that violate these Terms, with or without notice depending on the severity of the breach.
Upon termination, your access to the Service will cease. Data deletion will follow the schedule described in the Privacy Policy.
9. Changes to Terms
We may update these Terms as the platform evolves. Material changes will be communicated via email to your registered address with at least 14 days' notice. Continued use of the Service after that period constitutes acceptance of the updated Terms.
10. Governing Law
These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in the relevant jurisdiction.
